Lots of pokemon are basically slightly modified animals or copied from other series.
Nintendo and Palworld have both done this so at most both are guilty.
Calling all the designs identical is a bit of a stretch though. Some are definitly a bit muc but those are often also based off of mythology so I would give them a pass. I think this is why Nintendo didnt do this. They would not have won an IP infringment so they tried something else.
Mind you id say the patents arent really a better choice, I just think they were banking on pocketpair on taking the loss since the money they would have had to pay would have been small compared to the profit they made. I Still support pocketpair in this case at the end of the day as Nintendo is far from innocent and has no right to patent those mechanics. They can't sue for copyright, because Palworld didn't "copy and paste" Pokémon designs like you said they did use a similar design, but every design is handmade from the ground up, with inspiration from Pokémon so this is not within Nintendo's right to claim copyright infringement.
